Amendment of Items / Products
While we will endeavour to highlight any significant or substantive changes to you where possible, we reserve the right to change, modify, add or remove portions of these terms at any time. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Myrtle & Thyme Flowers' rights and obligations to each other.
Limitations
It is an essential pre-condition to you using our website that you agree and accept that Myrtle & Thyme Flowers is not legally responsible for any loss or damage you might suffer related to your use of the website, www.myrtleandthyme.com.au, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Consumer Act
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Myrtle & Thyme Flowers liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
You must be over 18 years of age to use this website and to make any purchase of any products.
Deliveries
It is the purchasers responsibility to ensure that all goods will be received by the recipient. Alternatively, Myrtle & Thyme Flowers will leave goods in a safe and secure place upon location.
If delivery of goods is deemed unsafe, they will be returned to Myrtle & Thyme Flowers and any re-delivery of goods will incur additional delivery fees, payable by the purchaser.
Delivery times may vary depending on the time of order and location of delivery.
Myrtle & Thyme Flowers is not responsible for goods that are either damaged in transit or not received upon delivery.
Weddings & Events
All Wedding & Event Flower Orders are to be paid upfront in full via online orders only.
If Myrtle & Thyme Flowers provide a custom quote, we require acceptance of all quotes no later than 4 weeks prior to your event. This is due to the ordering of stock and staff scheduling purposes.
Cancellations of any Wedding and Events Orders less that 2 weeks prior to an event date unfortunately are non-refundable.
Cancellations of more than 2 weeks prior to your event date will incur a 50% refund fee.
Please note any special orders on floral varieties / additions are not able to be refunded as these orders require a 4 week order period with suppliers / growers.
All Wedding & Event quotes produced by Myrtle & Thyme Flowers are valid for 30 days. Full payment of all Event Orders are required upon ordering of flowers. Events are then confirmed upon receiving full payment.
In the addition of hiring props, all props provided by Myrtle & Thyme Flowers are the property of Myrtle & Thyme Flowers and are provided on a hire only basis, unless purchased in full by the customer or client.
Myrtle & Thyme Flowers will deliver and collect all hired items with additional delivery fees applied.
If hired items are damaged whilst on loan the customer or client will be required to pay for the damaged items in full upon collection of items.
Myrtle & Thyme Flowers reserves the right to photograph all arrangements upon installation for promotional material use.
***In the event of a lockdown or due to government restrictions caused by COVID-19 or any pandemic / disaster with notice given by the client, bookings will be postponed / rescheduled with only the $100 non-refundable booking fee lost. We will work within our means to support all clients and their events to postpone and reschedule where possible. If Myrtle & Thyme Flowers are unable to reschedule the event booking due to unavailability, we will provide a full refund (less the booking fee).
PLEASE NOTE - If Government Notice is less than 7 days or if flowers have already been ordered / purchased then Myrtle & Thyme Flowers will require to retain 50% of the full amount upon refund or will invoice clients for an additional 50% to cover the cost of already ordering or needing to re-order flowers.
Returns & Refunds
Myrtle & Thyme Flowers handles returns and processes refunds in accordance with the Australian Consumer Protection Legislation.
Products sold on this website are a perishable, natural item and flower life span is dependent on species, resulting in some flower varieties living longer than others.
Flowers are a product of nature and availability is dependent on season and markets.
As a result, not all goods produced are as pictured on www.myrtleandthyme.com.au, and by accepting these terms and conditions you are acknowledging there may be discrepancies between images and produced goods.
Unfortunately Myrtle & Thyme Flowers does not provide exchanges or refunds based on change of mind or design and reserves the right to request images of original goods for our records to determine approval of replacement or refund.

To the fullest extent permitted by law, Myrtle & Thyme Flowers absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose.
Myrtle & Thyme Flowers gives no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our website or its server is free of viruses or any other harmful components.
At all times, we endeavour to have the most accurate, reliable and up-to-date information on our website, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information in its website or as to their correctness, suitability, accuracy, reliability, or otherwise.
It is your sole responsibility and not the responsibility of Myrtle & thyme Flowers to bear the entire cost of servicing, repairs, or correction.

At Myrtle & Thyme Flowers we are committed to protecting your privacy. All information we receive from our customers is securely stored as we respect the privacy and confidentiality of the information provided by you and adhere to the national privacy principles established pursuant to the Privacy Act 1988 (Commonwealth).
We do not store credit card information on our servers.
Third Parties
www.myrtleandthyme.com.au does not and will not sell or deal in personal or customer information. We may however use your details in a general sense without any reference to your name or your information to create marketing statistics, identify user demands and to assist in meeting customer needs generally. In addition, we may use the information that you provide us with to improve our website and customer service but not for any other use.
Disclose Your Information
Myrtle & Thyme Flowers may be required, in certain circumstances, to disclose information in good faith and where Myrtle & Thyme Flowers is required to do so in the following circumstances:
- By law or by any court;
- To enforce the terms of any of our customer agreements;
- To protect the rights, property or safety of Myrtle & Thyme Flowers, our customers and third parties
